ValueOne provides bulk SMS, transactional messaging, promotional SMS, WhatsApp Business API, RCS messaging, and related communication services via a technology platform that depends on multiple third-party infrastructure providers, including telecom operators, network carriers, cloud hosting providers, and Meta (for WhatsApp API). Accordingly:

3.1 Delivery Rates

While ValueOne maintains a high SMS delivery success rate through multi-network routing and DLT-compliant infrastructure, we cannot guarantee 100% delivery of all messages in all circumstances. Delivery may be affected by:

•     Recipient’s device status (switched off, out of coverage, storage full)
•     Telecom operator network outages or maintenance
•     TRAI-mandated DND (Do Not Disturb) filtering
•     DLT template non-compliance or sender ID issues
•     WhatsApp and Meta platform policies for WhatsApp Business API messages
•     Force majeure events including natural disasters, power outages, or government-ordered network disruptions

3.2 Transactional SMS and OTPs

For time-sensitive transactional messages such as OTPs and payment alerts, ValueOne prioritises high-speed delivery routes. However, we disclaim liability for any financial loss, security breach, or business disruption caused by delayed or undelivered transactional messages, to the maximum extent permitted by Indian law.

3.3 Platform Availability and Uptime

ValueOne aims for maximum platform availability. Scheduled maintenance windows are communicated in advance wherever possible. We are not liable for losses or damages arising from unplanned downtime caused by technical failures, third-party infrastructure outages, or events beyond our reasonable control.

ValueOne provides API documentation and support, but does not accept liability for integration failures arising from client-side implementation errors.

ValueOne provides a communication infrastructure platform. The content of all messages sent through our platform — including SMS text, WhatsApp message content, promotional copy, images, and interactive elements — is solely the responsibility of the sending business (our client).

By using our platform, you confirm and warrant that:

•     All messages comply with TRAI regulations, including template pre-registration requirements under DLT norms
•     You have obtained valid consent from recipients before sending promotional or commercial messages, as required by TCCCPR 2018
•     Messages do not contain false, misleading, defamatory, obscene, abusive, or illegal content
•     Messages do not violate any third-party intellectual property rights
•     You will not use our platform to send spam, phishing messages, or content that violates Indian law

ValueOne reserves the right to suspend or terminate any account found to be sending non-compliant, harmful, or illegal content, without prior notice and without liability to the client.

5. Third-Party Services and Links

Our platform integrates with and links to third-party services including telecom operators, DLT portals, Meta’s WhatsApp Business Platform, payment gateways, and external websites. ValueOne:

•     Does not endorse or take responsibility for the content, policies, or practices of third-party services
•     Is not liable for any loss, damage, or inconvenience resulting from your use of third-party services accessed through our platform or website
•     Cannot guarantee the continued availability or compatibility of third-party services, as these may change based on decisions by the third-party providers
